
David R. Suny
Dave is an experienced real estate and litigation attorney who has been practicing law for more than 25 years. He has extensive experience in advising clients under the Boston Zoning Code, handling large and small project review applications under Article 80 of the code, handling appeals to the Zoning Board of Appeal for various municipalities, and advising clients on federal, state and municipal permitting matters, including Section 106 of the National Historic Preservation Act. He also provides counsel to commercial real estate landlords and tenants, and other clients in connection with a broad range of commercial real estate issues, from zoning and permitting, to acquisitions and dispositions. He currently advises an international food service/entertainment company on local real estate matters, an international transportation company.
Prior to founding McCormack Suny in 2016, Dave was most recently a partner at the predecessor McCormack Firm in Boston, and prior to that served as a senior business and legal counsel to Cummings Properties, one of the Commonwealth's largest real estate development, leasing and property management companies. In this capacity, Dave has negotiated hundreds of leases involving virtually every possible use, from retail operations to research and development operations. In particular, he has extensive experience negotiating leases with life sciences companies, including a thorough understanding of zoning/permitting issues, as well as experience negotiating the legal and business terms associated with the technical aspects of the facility being leased, which are crucial to a successful tenancy.
Previously, Dave spent ten years as a commercial litigation attorney at Ropes & Gray (Boston) and Davis Polk & Wardwell (New York) and in-house litigation counsel with Cummings Properties. During this time, Mr. Suny first-chaired multiple state and federal court trials, as well. In addition to overseeing the firm’s real estate matters, he currently oversees an active litigation practice in which he recently obtained a defense verdict in a $1.5 million shareholder derivative case after a two-week jury trial in Middlesex Superior Court; as well as a $350,000 claim on behalf of a landlord against a tenant, and the individual owner after piercing the corporate veil, for which he successfully collected in full for the client through a follow-on post judgment civil action.

office lease in Boston
• represented international real estate fund in the sale of 130,000 square foot suburban
office building
• represented regional waste disposal company in the permitting and approval of a Waste
Transfer Station
Litigation:
• represented President of a regional cleaning company in a shareholder Freeze-out litigation
• Obtained $270,000 judgment after three-day bench trial in landlord-tenant litigation
• Representing major Boston-based mutual fund company in breach of contract claim seeking
$1,000,000 in damages
• Settled Wage Act Claim on behalf of Commissioned Sales person for three times the value
of the unpaid wages at issue
